Access to and use of the web pages located at the domain beckandcall.net (the "Site") by you (sometimes also referred to herein as the "User") is subject to, and constitutes your acceptance of, and agreement to comply with, the following terms and conditions (the "Agreement"). Beck and Call owns the intellectual property rights, including copyright, or has acquired the necessary licenses therein, in and to the information, including, without limitation, all text, HTML code, multimedia clips, images, graphics, icons, Java code, and the selection and arrangement of the contents of the Site (collectively the "Information"). The User is granted a limited, non-exclusive license to display the Information and print short extracts of the Information for the User's own personal use only, provided the Information is not modified, identifies the source, bears Beck and Call copyright notice as it appears above, and provided further that the User shall be fully responsible for any consequences resulting from such use. Any other use of the Information is strictly prohibited. Trademarks 

Certain words, phrases, names, designs or logos used on the Site constitute trade marks, service marks or trade names of Beck and Call or other entities as indicated. The display of any such marks or names on the Site does not imply that a license has been granted by Beck and Call or such other entities. Beck and Call will take all appropriate legal action necessary to fully and effectively enforce its rights, whether such rights are in respect of a trademark, service mark, copyright or any other intellectual property right or other right of Beck and Call under applicable law, as set out in this Agreement.

User's Warranties and Representations

The User hereby represents, warrants and covenants that the use of the Site by the User has not and shall not violate any applicable local, national or international law, including, without limitation, any regulations having the force of law. The User hereby covenants not to impersonate another person in the use of the Site or the sending of any email to an address listed on the Site.

Governing Law

The laws of the Province of Ontario and the laws of Canada applicable therein shall govern as to the interpretation, validity and effect of this Agreement notwithstanding any conflict of laws provisions or the User's domicile, residence, or physical location. The User hereby consents and submits to the non-exclusive jurisdiction of the courts of the Province of Ontario in any action or proceeding instituted under or related to this Agreement.

General

This Agreement sets forth the entire agreement between you and Beck and Call in respect of the Site and its contents and supersedes all prior agreements, whether written or oral, with respect to the subject matter hereof. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from these Terms and Conditions and the remaining provisions shall remain in full force and effect. Any failure by Beck and Call to enforce any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. This Agreement shall ensure to the benefit of and be binding upon each of us and our respective successors and permitted assigns.

RSS TERMS OF USE

RSS (really simple syndication) service is a means by which B&C ("Beck and Call") offers feeds of story headlines in XML format ("RSS Content") to visitors to the B&C portal ("beckandcall.net") who use RSS aggregators. These RSS Terms of Use govern your use of the RSS service. The use of the RSS service also is subject to the terms and conditions of the B&C Website Terms of Use, which governs the use of B&C, information services and content. These RSS Terms of Use and the B&C Website Terms of Use may be changed by Beck and Call at any time without notice.

Use of RSS Feeds:
RSS is a free service offered by B&C to individuals for private, non-commercial use. Any other uses, including without limitation the incorporation of advertising into or the placement of advertising associated with or targeted towards the RSS Content, are strictly prohibited. You must use the RSS feeds as provided by B&C, and you may not edit or modify the text, content or links supplied by B&C. For web posting, reprint, transcript or licensing requests for B&C material, please send your request through Beckandcall.net contact sources.

Link to Content Pages:
The RSS service may be used only with those platforms from which a functional link is made available that, when accessed, takes the viewer directly to the display of the full article on B&C. You may not display the RSS Content in a manner that does not permit successful linking to, redirection to or delivery of the applicable B&C web page. You may not insert any intermediate page, splash page or other content between the RSS link and the applicable B&C web page.

Ownership/Attribution:
B&C retains all ownership and other rights in the RSS Content, and any and all B&C and B&C logos and trademarks used in connection with the RSS service. You must provide attribution to B&C in connection with your use of the RSS feeds.

Right to Discontinue Feeds:
B&C reserves the right to discontinue providing any or all of the RSS feeds at any time and to require you to cease displaying, distributing or otherwise using any or all of the RSS feeds for any reason including, without limitation, your violation of any provision of these RSS Terms of Use. B&C and the other B&C entities assume no liability for any of your activities in connection with the RSS feeds or for your use of the RSS feeds in connection with your website.
